Hi3D Acceptable Use Policy

This Acceptable Use Policy (the“Policy”) governs use of the Hi3D websites, APIs, AI models and related services available through hi3d.ai (collectively, the“Services”). The Services are operated by Oceano HK Holding Limited (“Hi3D”, “we”,“us” or “our”).

This Policy forms part of the Hi3D Terms of Use and applies to all users, including API users and their end users.

1. Content and conduct covered by this Policy

This Policy applies to all prompts, text, images, videos, model files, textures, generated images and 3D assets, metadata, and API requests and responses submitted to, generated by or shared through the Services (“Content”).

You are responsible for your Content, your use of generated results, and all activity conducted through your account or API credentials. You must have all rights and permissions needed to submit and use Content.

2. Protect people from exploitation and serious harm

You may not use the Services to:

• create or distribute child sexual abuse material or otherwise sexually exploit, groom or endanger a child;
• create non-consensual intimate imagery or sexualized depictions of an identifiable person;
• threaten or promote terrorism, violent extremism, human trafficking or violence against identifiable people;
• encourage suicide or self-harm, except for genuine prevention, support or educational purposes;
• facilitate illegal weapons, controlled substances or other unlawful goods or services; or
• intentionally cause physical injury, property damage or other serious real-world harm.

3. Do not use Hi3D for abuse, hatred or deception

You may not use the Services to:

• harass, stalk, intimidate or expose another person's private information;
• promote hatred or violence based on protected characteristics;
• impersonate others or falsely claim sponsorship, approval or affiliation;
• commit fraud, phishing, identity theft, scams or other deceptive activity;
• distribute materially deceptive depictions of real people or events without clear disclosure where harm or confusion is reasonably foreseeable; or
• unlawfully interfere with elections or other civic processes.

4. Respect privacy, identity and biometric information

When Content identifies or depicts a real person, you must have a lawful basis and any consent or authorization required for your intended use.

You may not use the Services to:

• exploit another person's likeness, personal data or private material without permission;
• identify, track or monitor people without authorization, or build biometric-identification or mass-surveillance systems;
• infer highly sensitive characteristics or make consequential decisions about a person from biometric or personal data; or
• collect or expose passwords, financial details, precise location, medical information or other sensitive non-public data.

Do not submit personal data concerning a child unless you are legally authorized to do so and the use protects the child's best interests.

5. Respect intellectual property and authenticity signals

You may not use the Services to:

• infringe copyright, trademark, patent, design, trade secret, publicity or other rights;
• upload Content you do not have the right to use or violate applicable license terms;
• sell counterfeit assets, pass off another person's work as your own, or falsely claim that Content is official or endorsed; or
• remove or falsify watermarks, attribution, provenance or rights-management information to deceive others or conceal infringement.

If you make an asset public under a license such as CC BY 4.0, you must comply with that license. Rights already granted to others under the selected license may not be revocable.

6. No pornographic or exploitative sexual content

You may not use the Services to create or distribute pornographic or sexually explicit Content, sexual exploitation, bestiality or sexualized violence. Artistic, historical, medical or educational material involving nudity may be restricted where its context is unclear, unlawful or unsuitable for the Services.

Any sexual content involving minors is strictly prohibited.

7. Keep the Services and other users secure

You may not:

• introduce malware or code designed to compromise a device, account or network;
• test vulnerabilities without our prior written authorization;
• bypass authentication, safety controls, rate limits, payment controls or access restrictions;
• scrape or access the Services through automated means except through an interface or API we provide for that purpose;
• share or sell credentials or API keys, or use multiple accounts to evade enforcement;
• disrupt the Services through excessive requests, denial-of-service activity or spam;
• reverse engineer or extract models, model weights, source code, training data or confidential system information, except where law expressly permits; or
• use the Services or outputs to develop a competing AI model or service where prohibited by the Terms of Use or another agreement with us.

8. Responsible use of generated assets and 3D printing

AI-generated results may be inaccurate, incomplete, non-unique or unsuitable for a particular purpose. You must review results before use.

You may not use the Services to design or manufacture unlawful weapons, prohibited components, false safety certifications or products intended to harm people or defeat security controls. Generated models must not be the sole basis for medical, structural, automotive, aerospace or other safety-critical uses. Appropriate professional review, testing and approvals remain your responsibility.

9. API users and downstream applications

API users must:

• maintain reasonable terms and safeguards to prevent prohibited uses;
• ensure that end users have the necessary rights to submitted Content;
• protect API credentials and implement reasonable access controls and abuse monitoring;
• promptly address suspected misuse; and
• cooperate with reasonable Hi3D requests relating to safety, security or legal compliance.

You may not design an integration to enable prohibited activity or bypass Hi3D safeguards. We may restrict or suspend integrations that create material risk.

10. Enforcement

We may use automated systems and human review to investigate potential violations, but we are not required to monitor all Content.

We may block requests or outputs, remove or restrict Content, limit features or API access, or suspend or terminate accounts. We may act without advance notice where reasonably necessary to prevent harm, protect the Services or others, address security issues or comply with law.

Where required or permitted by law, we may preserve relevant records, respond to valid legal requests and report suspected criminal activity or serious safety threats to appropriate authorities.

11. Reporting and review requests

To report suspected misuse, contact legal@mathmagical.com with enough information for us to assess the issue. Copyright and trademark complaints should follow the procedure in the Hi3D Terms of Use.

If you believe a restriction was imposed in error, you may request review by contacting legal@mathmagical.com from the email address associated with your account.

12. Changes to this Policy

We may update this Policy to reflect changes in the Services, risks or legal requirements. We will post the revised version and update the “Last updated” date. We will provide additional notice where required by law.
